| In conclusion, the use of a polyanhydride-based implant for local and controlled release delivery of drug A was obvious from D2 and D1 including the documents D3, D4 and D6 cited therein. The applicant’s argument that there was no motivation to combine the disclosures of D2 and D1 does not succeed as long as no evidence is on file showing either a particular effect beyond a mere controlled release of drug A from the claimed poly(anhydride) or the failure to provide controlled release from the claimed poly(anhydride) for a considerable number of drugs. |
