Notwithstanding the foregoing, either Party hereto may bring an action against the other Party before any court of competent jurisdiction in the domicile of the defending Party the applicable law being that of the country of domicile, if and to the extent that any arbitral award rendered in the arbitration proceeding is unenforceable.
