J1-两年回国限制--（Two-Year-Rule） 已有3人参与

我于2013年从欧洲以J1签证到美国短期交流。 现在博士马上毕业，之前课题组有不错的机会能让我过去做两年博后。 那么请问 这个所谓两年Home country限制是指 我必须在欧洲这边待够两年还是在中国待够两年？ 可不可以申请非移民签证来避开两年限制，比如J签证过去作博后？ 我是公派，明白终归是要回国服务的，但是现在国内形势下，博士直接回去很难找到合适的工作！所以想申请延期回国，去美国多学点儿东西攒些资历再回国服务。 楼下有何高见？ |

2年限制，只限制申请H-1，L-1，green card签证。可以再次申请J1签证。 建议联系使馆问一下。如果楼主一直在美国。csc要延期，必须申请的。否则会算你延期回国的。 J-1 "visitors" (that is, J-1 students and scholars) who are what the INS calls "subject" to this requirement 212(e) must to return to their country of last legal residence for two years or obtain a waiver of this requirement before they are eligible for H-1B status (temporary employment), L-1 status (intracompany transfer), or Permanent Residence (a green card). May apply to an American Embassy overseas for a visa to return to the US in another non-immigrant status, e.g. F-1 (student visa), another J-1 Exchange Visitor Visa, J-2 dependent status, B-1 (visitor for business) or B-2 (Visitor for pleasure). Visa Issuing Officer at Embassy must determine visa eligibility. NOTE: An application for a new nonimmigrant visa must be made outside the US; if it is made within the US it is considered a change of status request and will be denied unless a waiver of the residency requirement has been granted. |
