| 寡妇立嗣是一种宗祧继承的特殊形式，它是中国传统身份法律制度中的重要内容，是我国古代身份法律制度的典型,在各个朝代的法律文献中, 我们都可以看到和立嗣的有关规定,其中就存在与寡妇立嗣有关的法律以及案例。在传统观念中，寡妇实际上是亡夫的人格代表，所以寡妇立嗣是一种责任和义务。发展到了近代，逐渐改变了这种传统，民国初年就改变了传统的寡妇立嗣的原则，寡妇在立嗣中延续了数千年的法律地位被重新定义，使得寡妇立嗣变成寡妇的一种权利。本论文详细地介绍寡妇立嗣法律的由来及其演变过程，系统探讨了寡妇的立嗣问题。通过在民国时期对寡妇立嗣这一传统的法律的修改展现的寡妇在立嗣中地位变化，以及在西方观念的冲击下中国法律对“权利”的解释，从中分析民国时期法律判定使得妇女境遇发生变化，这种变化虽然使得妇女有了一定的自主权，但是仍然带有传统约束力 |
