BUYER(翻译为买方) on its part warrants to A(翻译为A公司) that any process, technical information, data, equipment design or instructions furnished or given by BUYER to A shall not cause A in the performance of the work, activities and services under this Agreement to infringe any patent, registered design, trade mark, or copyright registered or otherwise existing in Japan and/or the P. R. China, on or before the Effective Date of this Agreement.

在此协议的生效日期之前（包括生效日期当天），根据协议规定，买方应根据自己义务向A公司保证：买方向A公司提供的任何工艺流程，技术信息，数据，设备设计或说明书不能涉及任何侵犯专利、已注册的外观专利、商标专用权或已注册的版权的行为（这些权利在日本和中华人民共和国境内都已得到保护），如涉及到这些行为，A公司也不应该承担任何责任。
