[交流] 请问美国J1签证如果从第三国申请,是不是到美国后需要交税?已有7人参与

请问从欧洲,如法国,德国申请美国J1签证,需要交很多税吗?貌似有从第三国办J1,需要依该国与美国协议,而不是中美协议,请问是这样吗?

是的,J1免税只有对中国国籍并且同时具有中国居住权的人是有效的。

这个所谓中国居住权,官方的规定是指在入美国国境之前,申请人或者申请人的单位或者单位的法人对中国政府因居住而有纳税义务。

显然,法国和德国的任何本土单位都不具有这个义务。

As far as I know, wherever you come from (China, France or Germany) as long as you are a Chinese citizen (you hold a passport issued by Chinese government), and hold a J-1 visa when entering the USA, you will be exempted from income tax including federal and state taxes for the first three years based on the treaty benefits between China and USA.

我们实验室前面的一个博后,中国护照,在德国3年,J1到美国后,需要缴税,不知道为什么?

我从香港申请,不需要交税。

但是好象可以依照法国和德国的J1政策,也是免的,具体的忘了.

那你要查一下,那个免税条款是否要求本人必须是法国国籍或者德国国籍。

有的时候,法国的条款并不能保护在美国的中国人。

我同事,中国国籍,在日本拿的Ph.D。入境美国后无法免税,

学校给的理由是,根据US-CHINA tax treaty A20。申请人必须是中国居民(a resident)

ARTICLE 20
(Students and Trainees)
      A student, business apprentice or trainee who is, or was immediately before visiting a Contracting State, a resident of the other Contracting State and who is present in the first- mentioned Contracting State solely for the purpose of his education, training or obtaining special technical experience shall be exempt from tax in that
Contracting State with respect to:
(a) payments received from abroad for the purpose of his maintenance, education, study, research
or training;
(b) grants or awards from a government, scientific, educational or other tax-exempt organization;
and
(c) income from personal services performed in that Contracting State in an amount not in excess
of 5,000 United States dollars or its equivalent in Chinese yuan for any taxable year.
The benefits provided under this Article shall extend only for such period of time as is reasonably
necessary to complete the education or training.

而其中A4又规定了,只有因居住的原因为中国(同美国签合约的那个国家,你的护照签发国)负有纳税义务,才可以叫居民。

ARTICLE 4
(Residence)
      1. For the purposes of this Agreement, the term "resident of a Contracting State" means any person who, under the laws of that Contracting State, is liable to tax therein by reason of his domicile, residence, place of head office, place of incorporation or any other criterion of a similar nature.


以上说明了,这个免税条款由申请人在入美国国境之前的居住状态来决定,而不只是由国籍来决定。
这些免税细则都写得明明白白,不懂自己查一下就清楚了。

你这个情况,应该是回国之后,从中国境内申请的签证吧。而不是在日本的大使馆直接申请的吧。

这样你在美国报税的时候只要自己不说,就没人知道。
