Dear Scholars: At midnight, if the President and Congress have not reached an agreement on funding measures, the U.S. government will shutdown, referred to as a funding gap, until an agreement is reached to either extend a temporary funding measure or a final budget deal is made. Therefore, this funding gap will have an impact on our foreign nationals and our visa application processes. The last time a funding gap took place was in 1995-1996 when the government experienced a 21 day shutdown. From these past experiences we have some guidance on which agencies and government processes will be affected and managed during this period. Essential functions and fee-based programs will continue, while non-essential functions will cease. Visa processing and related functions fall into both categories. Below, you will find three lists: Agencies we work with and how they will respond to this gap. Summary of the effects on the visas we process. Excerpt from the 1999 CRS report of what are considered essential functions. It also provides some additional details on a potential funding gap. Thanks, Sabreen ----------------------------------------------------------------------------------------------- Agencies Department of State (DOS) including embassies and consulates Most likely stop any non-emergency services including visa processing for both U.S. citizens and foreign national applicants. DOS has announced that applicants should make "prudent" plans with regards to interviews and processing currently underway and check in with individual posts/embassies. Student and Exchange Visitor Program (SEVP) This program is fee based; therefore, processing will continue to function as usual. US Citizenship and Immigration Service (USCIS) This program is fee based; therefore they will continue to function as usual. Customs and Border Protection (CBP) This agency function is considered an essential service under the law enforcement exemption therefore, will continue to function as usual. Department of Labor (DOL) Prevailing wage determination and labor condition application processes will most likely cease, but it is hard to determine if i-Cert will be available considering it was not in existence in 1995-96. ----------------------------------------------------------------------------------------------- Visa Processes Summary H-1B ◦ H-1B applications recently submitted and those in the prevailing wage or LCA stage will be put on hold. ◦ H-1B applications with certified LCAs will be filed with USCIS as usual. ◦ H-1B overseas applicants with approval notices will not be able to get visas at the U.S. embassy/consulate in their home country. J-1 ◦ J-1 processing will continue as usual. The IO will accept applications and process DS-2019s. ◦ J-1 overseas applicants who have received their DS-2019s and have NOT received their visas will not be able to get them until the gap is over. ◦ J-1 overseas applicants with their visas will be able to use them to enter the U.S. ----------------------------------------------------------------------------------------------- Essential Functions (Services and Personnel): A 1980 Office of Management and Budget (OMB) memorandum defines "essential" government services and "essential" employees as those: ◦ providing for the national security, including the conduct of foreign relations essential to the national security or the safety of life and property; ◦ providing for benefit payments and the performance of contract obligations under no-year or multi-year or other funds remaining available for those purposes; ◦ conducting essential activities to the extent that they protect life and property, including: × medical care of inpatients and emergency outpatient care; × activities essential to ensure continued public health and safety, including safe use of food, drugs, and hazardous materials; × continuance of air traffic control and other transportation safety functions and the protection of transport property; × border and coastal protection and surveillance; × protection of federal lands, buildings, waterways, equipment and other property owned by the United States; × care of prisoners and other persons in the custody of the United States; × law enforcement and criminal investigations; × emergency and disaster assistance; × activities that ensure production of power and maintenance of the power distribution system; × activities essential to the preservation of the essential elements of the money and banking system of the United States, including borrowing and tax collection activities of the Treasury; and × activities necessary to maintain protection of research property.(5) <http://ncseonline.org/nle/crsreports/government/gov-26.cfm#N_5_> |

WASHINGTON – Perilously close to a government shutdown, President Barack Obama and congressional leaders forged agreement late Friday night on a deal to cut more than $37 billion in federal spending and avert the first closure in 15 years. Obama hailed the deal as "the biggest annual spending cut in history," and House Speaker John Boehner said that over the next decade it would cut government spending by $500 billion. "This is historic, what we've done," said the third man in the talks, Senate Majority Leader Harry Reid, D-Nev. They announced the agreement less than an hour before government funding was due to run out. Still under the gun, lawmakers raced to pass an interim measure to prevent a shutdown, however brief, and keep the federal machinery running for the next several days. |
