| 摘要：近年来，我国政府工程管理的法律体系日臻完善，《中华人民共和国建筑法》、《中华人民共和国招标投标法》、《中华人民共和国政府采购法》等法律法规先后出台，为规范政府工程项目的管理提供了法律保障。然而，这些法律法规在实际的执行当中，却几乎都存在不同程度的问题。这就是政府工程管理法律体系自身所存在的漏洞和缺陷，以及执行过程中的不严格，致使不法分子有机可乘，损害国家和人民的利益。在我国重特大贪污贿赂的刑事案件中，大多数公职人员的职务犯罪，均是与政府投资的建设项目存在着千丝万缕的联系。由此可见，进一步加强政府工程法律体系建设以及加强政府工程管理法律法规的执行力有着十分重大的意义。本文试从政府工程的概念及分类入手，分析我国政府工程管理法律体系建设现状以及政府工程管理中存在的突出问题，并通过借鉴西方发达国家政府工程管理的方式，提出加强政府工程法律体系建设和法律法规执行力的建议。 |

| Abstract:Recent years witness the graduate perfection of Chinese legal system on governmental project management.The crafting and taking effect of the Chines Construction Law ,the Chinese biding law,the Chinese Government Procurement law etc provide legal framework to effectively monitor the governmental project management.However，there are a variety of problems in the implementation of these laws.The reasones for such problems can be ascribed to the intrinsic imperfection of the relevant laws as well as the not strict law enforcement which are taken advantage of by the outlaws and result in loss to both the nation and the people.In most of the exporsed serious corruption and bribery cases，many involved public officials did wrong with respect to construction projects funded by the government to some extent.Therefore further improvement of relevant laws and beefing up the law enforcement apprears to be urgent and significant.In this article,I analyze the current Chinese governmental project management conditions and existing major problems in accordance with the concepts and classification of governmental project and provide suggestions on improvement related laws and strengthening law enforcement by reference of the advanced experience taken by western countries. |
