Issue180 Many problems of modem society cannot be solved by laws and the legal system because moral behavior cannot be legislated. 提纲: 1. 法律和司法系统起源于人类的道德准则。 2. 法律如何通过讲道德立法来保证社会的安定。 3. 让步:的确有很多问题由于法律不能左右人类的道德行为而无法解决。 Laws and legal systems are all the time the implement of human to regulate and control the society thus to make it develop and progress. However, there still exist so many problems which cannot be solved by them. In my view, legal systems not only can legislate but also can be the best embodiment of morality, even if they are not the panacea for every problem of our society. Although the function of laws and the legal system varied throughout the history, the fundamental root of them is morality in a sense. This could be easily understood if we cast a look back at the evolution of laws and legal system. In the old days, when laws and such systems did not exist, human’s behaviors were regulated by the moral censorship of his/her neighborhood, or the group he/she belonged to or even the whole society. Morality plays an important role as the prototype of laws. As the society became more complicated, laws and legal systems eventually appear. Nowadays, they are used to govern the people by regulating people’s behavior and to protect people’s right by combating crimes with a great number of rules of laws, which are originated from the primitive “laws” of human society—morality. Obviously, morality has far been legislated from the past, through the present and to the future. In order to maintain a peaceful and stable society, this kind of legislation is indispensable. Why do we have traffic laws? Why do we have to drive our automobiles on the correct side of the road and stop at the red traffic lights? Why do we have laws governing the food and medicine industry’s handling? Why do we have laws that make murder, stealing, drug trafficking and perjury in court illegal? If human morality cannot be legislated, the aftermath could just be disasters. Human civilization is, in fact, grounded and dependent on the fundamental principle that human behavior can be legislated. And fortunately, they are legislated in our laws and legal systems, so that we now can have a relatively stable society rather than a disordered one. However, that is not to say that every aspect of human morality can be regulated, because we cannot control human’s nature and neglect human’s personal right. What a person does on his/her own have nothing to do with the public or the society because it is his/her right. Laws cannot order a lazy person to be diligent, even though idleness causes so many problems, such as poverty and other forms of crime. Laws also cannot control people’s lust for power, for money, for sex and so on. The lust itself is faultless but some people may choose to attain such goals by immoral behaviors. That is why crime rate of corruption, stealing, robbery, warfare and so forth is still high, even there are strict laws and punishments. Social life and private are sometimes separate issues. An individual’s private life may result in serious consequences, however, it is his/her right to do so, and laws can do nothing to control his/her choice and human’s nature. That is why today, there are still many problems cannot be solved. Laws and legal systems are root from morality, and nowadays our society still depend on them to regulate human’s behavior in order to maintain relatively peaceful and stable. However, morality is so complex that it is impossible for laws to reach every aspect of morality. Only by amalgamating both of the two factors can human society be more prosperous and advanced. |
