【Pure water】Baidu may be sued for copyright infringement

Baidu, China's most popular search engine, is set to face a lawsuit for allegedly infringing on the copyrights of more than 100 writers and publishers, Economic Information Daily reported Thursday. "This time we are not only asking Baidu to remove all the infringing works, but also aiming to shut down Baidu Library", best-selling author Xu Lei told the newspaper, According to Xu, who is popularly known as Nan pai san shu (an online moniker) from the Secrets of a Grave Robber series, 22 famous authors including Han Han and Zhu Deyong have released a cooperative statement denouncing the infringement of Baidu Library and decided to file a lawsuit against the website, the newspaper said. This is not the first time Baidu is entangled in high-profile legal action. The online store Dangdang.com and the leading online literature website Shanda Literature Limited (SDL) filed suit against Baidu for alleged copyright infringement earlier this year. One netizen said, based on search results from Baidu Library, Xu's series Secrets of a Grave Robber may have been downloaded between 100,000 to 300,000 times, which causes the author at least 500,000 yuan in financial loss. A representative from Baidu argued that Baidu Library is an open platform where netizens share their resources online. All documents and profiles are uploaded by netizens. Baidu did not infringe the rights of authors and publishers. A lawyer said in this case, network platform providers are responsible for removing infringed works. The defendant does not bear tort liability if the infringing content is not stored on its servers and has not been told what contents they should remove. |
