背景：去年1月份，某专利代理所一名律师委托我搜集一宗跨国无效案的证据。 案情：请求人打算对两件外观设计专利（蜗杆回转支承的变速器）提出无效请求，可是该律师苦于找不到在先设计。请求人提供的线索中有一家德国公司在销售这种产品，但该公司具体名称未详。该律师希望我能找到相关商业广告或者产品宣传册，并最好能找到这家德国公司的具体名称及其在中国销售的相关线索。并提供了两件中国外观设计的图片和照片，作为寻找在先设计的依据。 线索实在很少。我先通过网络调查“蜗杆回转支承的变速器”(律师提供的名称)和“回转式减速器”(外观专利中的名称)的相关产品以及它的英文名称。找到了类似的产品：回旋支承 其对应英文名称为：slewing bearing 或 turntable bearing，但我使用此关键词查遍了欧美的专利，但未找到相似者。我又通过slewing bearing检索到它的德语名称为Schwenktriebe，终于查到德国IMO公司生产外形相同的产品，如下两图： 剩下的任务就是要找到它的相关专利信息，或者出版物。我使用IMO公司提供的英文名Slew Drives检索仍然没有收获。最终还是使用德语名称Schwenktriebe以及申请人IMO作为关键词，检索到了该专利，该专利摘要中其英文名称为Swivel drive。（这就是为什么使用slewing bearing、turntable bearing、Slew Drives检索不到的原因。） 但是该德国专利并未申请中国专利保护，要想无效该中国外观专利，就必须找到纸质出版物，或者证明其曾在中国销售（外观申请日之前）。我通过检索，搜索出了国内4家厂商曾进口该产品，并他们联系，但国内厂商大多不愿出面作证。于是律师希望我能调取纸质说明书，于是我冒以某与IMO有商务关系的企业之名义，写信给了IMO公司，顺利得到相关说明书纸件。然后经过德国使馆公证、认证，中国使馆认证，寄回国内，案件最终有了圆满的结果。整个过程都是我独立作业，6小时内就找到相关专利。 后来经过进一步搜索，我发现其实这可能是一桩国际侵权案。我发现这个外观申请人是一个美国人，他在美国设有KINEMATIC公司，且KINEMATIC公司在世界各大洲都有销售代理。 右图是该公司产品的图纸。（与IMO公司的专利摘要图十分相似）。 我曾建议的专例代理公司和IMO公司联络，可能是新的业务。可惜无果而终。 |

The clues provided by the person making the request pointed toward a Germany corporation selling this kind of products but not identified its name. The lawyer hoped that I could find out related commercial advertisements or product manuals and it would be best that I could trace the specific name of the Germany corporation as well as its sales clues in China. I first traced on the Internet the related products and their English titles of the “worm slewing bearing transmission (given by the lawyer)” and the “rotary redactor (shown in the patent of design). Analogous product was found: 回旋支承. The corresponding English term was: slewing bearing or turntable bearing.
