目前，全国绝大多数城市的污水处理能力远远满足不了实际需要。 随着人口迅速增加和人民生活水平的日益提高，生活污水产生量大幅度增长。近年来，城市生活污水和工业废水排放量的比例已接近持平。但是，城市污水处理厂的建设远远不能适应经济社会发展的需要。因此，环境保护投资不能有效发挥环境效益。 垃圾焚烧、汽车尾气排放等常产生一些环境污染物，如多氯联苯、二恶英等，通过空气污染、土壤污染等途径最终导致水体污染。另一方面，一些农业投入品的使用，农药残留、渔药残留等问题，也严重威胁饮用水的安全性。 据统计[17]，2004年水污染突发事件14起，只有沱江污染事件被追究刑事责任；在2005年水污染突发事件中，只有1起被追究刑事责任；2006年水污染突发事件18起，仅有3起追究了污染企业的刑事责任；2007年的9起水污染事件中没有人被追究刑事责任；2008年，5起水污染事件被追究刑事责任。经过20多年的努力，我国的环保执法能力已经有了很大的改观，但相对目前繁重的环境执法任务而言，仍有明显差距，水环境监管的执法权威和刑事制裁手段有待进一步提高。 |

At present, the vast majority of the city's sewage treatment capacity is far failed to meet the actual needs. With the rapid population growth and increasing living standards, a significant increase in the amount of domestic sewage generated. In recent years, city sewage and industrial wastewater emissions, the ratio is close to flat. However, the construction of urban sewage treatment plants is far can not meet the economic and social development. Therefore, the environmental protection investment can not effectively play environmental benefits. Waste incineration, automobile exhaust emissions, often gives rise to a number of environmental pollutants such as PCBs, dioxins and so on, through air pollution, soil pollution, and other channels leading to water pollution. On the other hand, the use of some agricultural inputs, pesticide residues, Drugs Residue and other issues, but also a serious threat to drinking water safety. According to statistics [17], in 2004 water pollution incidents in 14 cases, only the Tuo River pollution incident has been held criminally responsible; water pollution incidents in 2005, only a beginning has been held criminally responsible; 2006 water pollution incidents 18 cases, only 3 cases of contamination of enterprises held criminally responsible; 2007, 9 cases of water pollution incident no one has been held criminally responsible; in 2008, 5 cases of water pollution incidents has been held criminally responsible. After 20 years of efforts, China's environmental law enforcement capacity has been greatly improved, but relative to the current onerous environmental enforcement tasks, there are still significant difference between the water environment monitoring law enforcement authority and criminal sanctions to be further improved. |

Currently, capacities of sewage treatment in most of cities across the country are far from enough to meet the practical requirements. With the rapid growth of population and continuous improvement of the living standards, the output of sewage from life is greatly increased. It is nearly equal to the output of the waste water generated in industries in recent years. However, the construction of the plant for the urban sewage treatment is far from fitting to requirements of the development of economic society. Therefore, the investment to the environment protection can not effectively function in efficiency and benefit. Garbage burning and automobile exhaust emissions often generate some pollutants that pollute environment such as PCBs, dioxins and so on. All these pollutants will finally pollute water by ways of the air pollution and soil pollution. On the other hand, the applications of some cultivating additions, residues of pesticide and weed killer and residues of fishery drugs are also a serious threat to the safety of the drinking water. According to the record, there were 14 emergency cases of the water pollution in 2004. Only one case of the water pollution of Tuo river was juridically investigated and passed judgment as a criminal responsibility. For cases of the water pollution happened in 2005, only one cases was juridically investigated and passed judgment as a criminal responsibility. For 18 cases of the water pollution happened in 2006, only three cases were juridically investigated and passed judgment as criminal responsibilities of three enterprises which incurred the pollution. For 9 cases of the water pollution happened in 2007, no people were juridically investigated and passed judgment as a criminal responsibility. 5 cases of the water pollution happened in 2008 were juridically investigated and passed judgment as a criminal responsibility. With more than 20 years’ hardworking, the capability of the law enforcement of the national environment protection has great improved. However, it is still not enough if compared with the current intense tasks of the law enforcement. Both the law enforcement authority of the water environment monitoring and means of the criminal punishment require to be further improved. |
